The Failure of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the tension caused by the introduction of a new 28-point plan for resolving the conflict appeared – briefly – to have been contained. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its response: another massive barrage of rocket attacks on Kyiv.

The Rhythm of Negotiation and Warfare

The succession of opposing developments captured the harsh reality of the current period. By day, negotiation efforts are fought: hopeful statements are delivered from various governments. Significant resources is allocated on containing particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, war remains the main instrument for achieving "resolution".

Nighttime Reality

As military strikes progressed into the early hours of Tuesday, the current condition of Ukraine's exposure was revealed. Ukraine is equipped to monitor projectile deployments from enemy soil, a capacity afforded by current data. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to counter approaching aerial threats roared overhead – advanced fighter aircraft provided to Ukraine by European allies.

Soon thereafter, Kyiv's air-defence systems engaged: defensive missiles targeted at a incoming threat. This was a modern interception technology at work, most likely provided by Western nations. Every firing creates sudden vibrations, rattling buildings. The instant of fear quickly becomes sober acceptance: possibly the approaching threat won't cause damage this time, preventing destruction from ruin and another blackout.

Continuous Dangers

Not long after, a large-caliber weapon fired at a unmanned aircraft in the vicinity, part of a defensive team – probably imported technology. Unfortunately, the bullets missed the hostile drone – it maintained course toward its target.

With pauses, this persisted until dawn. Kyiv greeted the daybreak reports: seven people killed, destruction and heating outages in many homes as a result of the night's assault. As customarily, everyone still went about their day – living the war. But those full day demonstrated Ukraine's critical military reliance on Western support – a reliance that European nations are evidently unprepared to replace in the immediate future.

Ineffective Peace Efforts

The detailed framework from American leadership provoked deep reactions, debate and deep concern – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new approach from Washington follows the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually secure success. This trend will, no doubt, endure.

Political Considerations

It is tempting to accuse specific actors of repeatedly advocating Russian terms. But that does not seem to be the whole story. Washington operates on a premise understood by international relations experts: you cannot secure via talks what you have failed to defend militarily. The American government believes that it is unrealistic to force Russia to surrender the areas that it presently holds in Ukraine's occupied territories.

The challenge is that while accepting these circumstances, US leadership does minimal to discourage Russia, through diplomacy or military means, from thinking that the situation will not change more in its advantage in the near future.

Opposing Positions

Therefore, Moscow is convinced that duration works to their advantage – that Ukraine and its supporters are nearing depletion. Their incentive to accept conditions that does not give them the maximum possible gain is close to zero. There may be multiple initiatives to achieve ceasefire, but they will continue as long as Russia's leadership remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still endure, slowly losing civilians and areas but preventing a entire defensive failure until conditions improve in its advantage.

Present Conditions

Realistically, there are no actual prerequisites for a ceasefire. Now, individual motivations are coming into play: leadership ambitions to mediate resolution and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the flag against any initiative Kyiv finds unsuitable, so that their focus does not move to internal issues. And although their task will now be considerably more difficult after recent developments, it remains highly unlikely that this will alter their fundamental strategy.

These two forces are influencing discussions.

Assessment and Future

It took a mere seven days to terminate the suggested clauses of the current initiative. Forceful and unpredictable management of the matter by American leadership, resistance by Ukraine and the other European countries, along with pacifying measures of diplomats, and finally, latest revelations, all did their job.

While new plans based on previous concepts are forthcoming, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and demonstrate specific hesitation to alter the situation, if they remain united and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the foreseeable future, primarily depend on sustained allied backing.
